This lawsuit claims that Diamond misbranded its walnut products by making false and misleading statements on
package labels and the company’s website relating to the health benefits of walnut consumption. Diamond
denies it did anything wrong, defended itself throughout this litigation and asserts that its labels and website
were truthful and consistent with the law. The Court has not decided who is right. Both sides have agreed to
settle the dispute and get benefits to consumers.


Welcome to the Zeisel v. Diamond Foods Settlement Website.

This website informs you of a proposed Settlement of class action claims against Diamond Foods, Inc. (“Diamond”) alleging that Diamond mislabeled and misbranded its walnut products. You are a class member if you are a consumer who purchased Diamond of California brand walnuts (which include, but are not limited to, Shelled, Halves, Chopped, Finely Diced, Chips, Nut Topping, and In-the-Shell Walnuts products) for personal or household use in the United States from March 22, 2006 through January 30, 2012. Purchasers who bought walnut products for resale are not included.

If you are a class member, Diamond has agreed, under the terms of the Settlement, to provide you with the opportunity to submit a valid and timely Claim Form through which you may be eligible to receive monetary compensation as discussed throughout this website.

Deadline for filing a claim: Postmarked before 10/26/2012.

The Settlement creates a Settlement restitution of $2,600,000, Under the Settlement, an eligible Class Member who timely submits a completed Claim Form with any required proofs of purchase and who made eligible purchases of:

(a) 3-pound bags of Diamond of California walnuts at Sam’s Club is entitled to receive $8.25 per bag; (Your Claim for 3 lbs bags of Diamond of California walnuts purchased from Sam's Club will be rejected if you fail to include your Sam's Club Membership number. A Sam's Club Membership number is not required for any other size bag claimed.)

(b) any Diamond of California walnut product (other than the 3-pound bags described in (a)) is entitled to $3.25 per bag.

Class Members who claim more than three 3-pound bags of Walnuts or more than five bags of any other Walnut products must also submit Proof of Purchase. Proof of Purchase is not required for claims of three or less 3-pound bags of Walnuts or five or less bags of any other Walnut products.

Thanks Dolores. I filed a claim. I prob bought more than 3 bags, but don't have any proof of purchase. I mean, who would keep that??

Diamond of California Walnuts has agreed to provide $2.6 million in restitution to consumers. Requires that you purchased Diamond of California brand walnuts (shelled, chopped, etc) 3/22/06 to 1/30/12. Class Members who purchased a 3-pound bag of Diamond of California walnuts at Sam’s Club are entitled to receive $8.25 per bag, while Class Members who purchased any other Diamond walnut product can receive $3.25/bag. To receive your cash refund from the Diamond walnut class action lawsuit settlement, you must submit a claim form (which may be submitted online) before 10/26/2012. thank you I would have never known and have you bought these lateley OMG i did last month for cookies i baked and 3.25 a bag reimbursement is about 1/2 the cost some one is really making a profit! thanks again tim

Thanks for this. I filed a claim and shared it with my friends so they can too. I bought way more than 5 bags, but like Dawn said, there is no way I kept proof of it! Keeping proof for 6 years, really??? I would guess I easily bought 30 or more bags. I do a lot of baking and make things to sell so I go through a lot of walnuts!!

You're right Lois. It's just like the Breyer's Ice Cream settlement. I bought a ton of Breyers, but who saves all their grocery receipts? Except maybe the crazy coupon ladies, and they cheat!
