1. ELIGIBILITY:
The Sweepstakes is open to legal residents of the United States and District of Columbia, who are 18 years or older as of date of entry. Employees and agents of LearnVest and GradSave [and their parents, affiliates and subsidiaries, and their immediate families (parents, children, siblings and spouses) and their same household members are not eligible. Void outside of the United States and District of Columbia, and where prohibited by law. Void in Puerto Rico. Subject to all federal, state and local laws and regulations.
2. SWEEPSTAKES SCHEDULE:
The Sweepstakes begins on or about 9:00 PM Eastern Time (“ET”) on July 17, 2013 and ends 11:59 PM ET on Sep 15, 2013 (“Promotional Period”).
3. HOW TO ENTER:
To enter the Sweepstakes online, go to the “Promotional websites”: https://www.learnvest.com/s/signup/internal/college-savings-sweeps/ and create a new LearnVest account with a valid email address and password. No purchase is necessary to create a LearnVest account. Only valid for new email addresses that do not have a current LearnVest account. By creating a LearnVest account, you’re agreeing to receive the LearnVest Daily.
Limit of one (1) entry per person during the entry period either online. Any person who attempts to participate with entries in excess of these entry limitations will be disqualified. Any other attempted form of Sweepstakes entry is void. Any person who attempts to participate under multiple identities or uses any device or artifice to enter in excess of this entry limitation will be disqualified; use of programmed, automated or like means of entry is prohibited. All duplicate entries will be discarded.
4. WINNER DETERMINATION:
One (1) Winner will be determined by a random drawing from all eligible entries and will occur on or about the week of Sep 14, 2013. The sponsor reserves the right to delay the random drawing. The number of eligible entries received will determine the odds of winning. Winning entries are subject to validation.
5. WINNER NOTIFICATION:
The sponsor or a representative of the sponsor shall contact potential winner by email on or about the week of Sep 23, 2013. No responsibility is assumed by LearnVest for any incorrect email address provided by a participant. Potential winner may be required to execute and return an affidavit of eligibility, liability release, and (where legal) an affidavit of publicity prior to receiving the prize. Winner will have forty-eight hours from the time he/she is contacted to respond and accept the prize. Noncompliance with the time period described above will result in disqualification and an alternate winner selected. Winner may be required to present proof of identification prior to claiming prize. Acceptance of any prize shall require acceptance of the terms of these Official Rules and shall grant the sponsor the right to use Winner’s first name, last name and city and state of residence for any publicity associated with this Sweepstakes.
6. OTHER TERMS AND CONDITIONS:
The sponsor reserves the right to disqualify any individual that the sponsor determines in their sole discretion to be tampering with the Sweepstakes (including the entry process). The sponsor may prosecute fraudulent activities to the full extent of the law. The sponsor and Prize Providers reserve the right, in their sole discretion, to substitute the advertised prize (or component thereof) with another prize/prize component of equal or greater value should the advertised prize/prize component be unavailable for any reason. Unless otherwise prohibited by law, Winner grants The sponsor and their affiliates and subsidiaries permission to use Winner’s name (as described above) for advertising/trade/promotional purposes and to disclose Winner’s first name, last name, city and state without further notice or further compensation. Winner agrees to release and hold harmless The sponsor and their affiliates and subsidiaries and their directors, officers, employees, and agents from any damage, injury, loss or other liability that might arise from their participation in this Sweepstakes, or from their acceptance, use/misuse of prize, or from the malfunction of prize. The sponsor make no warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize including without limitation to its quality, merchantability or fitness for a particular purpose. The only warranties/representations/guarantees are those of the prize manufacturer.
The internal laws of the Commonwealth of Pennsylvania will govern the Sweepstakes, these Sweepstakes Rules, and any disputes regarding these Sweepstakes Rules and/or this Sweepstakes. Any attempt to deliberately damage or undermine the legitimate operation or fair play of the Sweepstakes may be in violation of criminal and civil laws and will result in disqualification of the Participant from participation in the Sweepstakes. Should such an attempt be made, the sponsor reserve the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.

If a Winner is unable or unwilling to accept the prize he/she will be disqualified and the prize forfeited; and, in such event, an alternate Winner shall be selected from among all remaining eligible entries received. Prize cannot be substituted or transferred by Winner. If a Prize must be forfeited, Winner will not be given the cash value of the prize. Prize Winner is solely responsible for all expenses not expressly included. All taxes are the responsibility of the Winner. Winner and/or parent or legal guardian may be required to sign an IRS Form 1099, Form W-9, or the equivalent for all prizes valued at $600 or greater, or for any prize as to which The sponsor, in their sole discretion, believes it is warranted.
