Fall is here and Winter is fast-approaching. That’s why we want you to enter now to win a some Pearl Izumi Winter Cycling Gear! The Pearl Izumi Winter Cycling Gear Contest (the "Contest") is an Enter-to-Win contest. Participants can willingly submit an entry form online at www.nashbar.com. Participants can not submit an entry form by phone. Contest Administrators will randomly choose the winning entry and prizes will be awarded in accordance with these Official Rules.
III. SPONSOR
The Contest is sponsored by Performance Inc., a North Carolina corporation with principal place of business at 1 Performance Way, Chapel Hill, NC 27517, USA.
The laws of the State of North Carolina shall govern this Contest, without regard to North Carolina's choice of law rules or the choice of law rules of any other jurisdiction that would cause the application of any jurisdiction's laws other than those of the State of North Carolina. The courts of North Carolina in Chatham County shall be the exclusive forum and venue for any dispute relating to these Rules and/or this Contest. All participants and winners agree, by their participation in the Contest, to submit to the personal jurisdiction of the courts of North Carolina in Chatham County.
IV. BINDING AGREEMENT
In order to enter the Contest, you must agree to these Official Rules ("Rules"). The Rules consist of the terms and conditions on this page and the Entry Form and Consent Form ("Contest Materials"). Because you will be bound by these Rules and these Rules will form a legally binding agreement with respect to this Contest, please read them carefully. You may not submit an entry to the Contest and you will not be eligible for the prizes described in these Rules unless you agree to these Rules. You agree that an entry in the Contest constitutes your agreement to these Rules.
V. ELIGIBILITY
Open and offered only to legal residents of the 50 United States and District of Columbia, who are 18 years of age or older as of Monday September 30th, 2013. Employees and directors of Sponsor, Performance, Inc., and its parent, subsidiaries and affiliated companies, advertising, promotion or production agencies, and their immediate family members or individuals residing in their same household (whether related or not), are not eligible to participate or win a prize.
VI. PROMOTION PERIOD
The Contest begins at 02:30:01 a.m. Eastern Standard Time (ET) on September 30th, 2013 and ends on 11:59:59 p.m. Eastern Standard Time (ET) on November 24th, 2013. Sponsor's computer will be the official time clock for the Contest.
VII. HOW TO ENTER
Participating contestants may enter the Contest using the method described below:
(1) Online: During the Promotion Period, visit www.nashbar.com. Form must be completed in its entirety to be eligible. You will then receive one (1) entry into the contest. All entries must be received no later than 11:59:59 p.m. ET on November 24th, 2013. Participants cannot enter by phone.
VIII. RANDOM DRAWING
Contest Administrator will select one (1) winner from all eligible entries in a random drawing on or about December 2nd, 2013 for the 1st Prize. Potential winners will be notified by email on or about December 9th, 2013. If a winner does not respond to notification within five (5) days of the date of notification, prize will be forfeited and an alternate winner may be selected. Limit one (1) prize per person/household. Odds of winning depend on the number of entries received.
IX. PRIZES
One (1) 1st prize winner will receive: one (1) Barrier Jacket, one (1) Pair of Cyclone Gloves, one (1) Pair of Shoe Covers, one (1) Pair of Wool Socks and one (1) Pearl Izumi Cycling Cap.
