The trial is to decide whether the claims being made against Kashi, on behalf of purchasers of certain Kashi food products, are correct. Judge Marilyn L. Huff of the United States District Court for the Southern District of California is overseeing this class action. The lawsuit is known as Astiana, et al. v. Kashi Company, Civil Action No. 3:11-cv-01967-H-BGS.
This lawsuit is about whether Kashi misbranded certain of its food products. The Plaintiffs claim that Kashi falsely advertised certain food products by labeling those products (i) “Nothing Artificial” when they contained one of more of the ingredients Pyridoxine Hydrochloride, Alpha-Tocopherol Acetate and/or Hexane-Processed Soy ingredients (the “Nothing Artificial Products”); or (ii) “All Natural” when they contained one or more of the ingredients Pyridoxine Hydrochloride, Calcium Pantothenate and/or Hexane-Processed Soy ingredients (the “All Natural Products”). Kashi denies it did anything wrong, and asserts its labels were truthful and consistent with the law.
There is no money available now, and no guarantee there will be. Lawyers must prove the claims against Kashi at a trial currently set to start February 11, 2014. If money is obtained from Kashi, notice will be publicized about how to ask for a share.
