GRAND PRIZE: Winner must accept, claim and take possession of the complete Grand Prize described below or he/she will forfeit the Grand Prize in its entirety. Grand Prize will be comprised of the following:
• One (1) 2016 Model Year Toyota Tundra SR5 Double Cab equipped with 5.7L V8 and Premium package including Entune™ Premium Audio with Navigation and App Suite and front bucket seats with power driver’s seat with power lumbar support, floor-mounted urethane shift lever and knob, tilt /telescopic urethane steering wheel, three front cup holders, front console box, auto-dimming review mirror with compass and HomeLink® 15 universal transceiver, anti-theft system with alarm and engine immobilizer, 18-in. TRD off-road alloy wheels, Bilstein® shock absorbers, rear-side privacy glass, engine skid plate, fuel tank skid plate, and decal, Spray-On Bedliner and All-Weather Floor Mats (“Prize Vehicle”). The manufacturer’s suggested retail price (“MSRP”) of the Prize Vehicle to be awarded is Thirty-Nine Thousand Nine Hundred and Fifty Dollars ($39,950). Any options desired by the Winner will be at the sole cost and expense of the Winner. The Prize Vehicle will be delivered solely with the express written limited warranties specifically set forth in the Prize Vehicle’s applicable owner’s guide, which warranties shall run for the term set forth in said guide. Toyota and Sponsor disclaim, to the full extent of the law, any other warranties in the connection with the Prize Vehicle. Exterior or interior color of Prize Vehicle is subject to availability. The vehicle depicted on the designated landing page and/or in any advertising, promotional materials or physical display may NOT reflect the actual Prize Vehicle awarded to the Winner; including but not limited to the Prize Vehicle awarded may not be of the same color or have the same features or options as the depicted or displayed vehicle. In the event the particular model of the Prize Vehicle becomes unavailable, or if circumstances are such that awarding such model would be damaging to Sponsor’s reputation (due to recall or other similar circumstances), Toyota will supply an alternative prize vehicle of comparable or greater value. Subject to availability and excluding any delay for special order vehicle customization or vehicle manufacturing production delays, Toyota shall use reasonable efforts to arrange delivery of the Prize Vehicle to the authorized Toyota dealership or distributor selected by Toyota closest to the Winner’s primary state of residence in the Continental United States, Alaska, Hawaii or District of Columbia (“specified delivery site”) within one hundred eighty (180) days after Toyota’s receipt of the information, items and documents from the potential Winner as required per these Official Rules and necessary to transfer the Prize Vehicle legally in the Winner’s primary state of residence. Toyota and Sponsor shall not be responsible for any delays in delivery of the Prize Vehicle that are not within their control; delivery will be subject to availability. The Prize Vehicle will be delivered to the specified delivery site determined by Toyota, only. The Winner MUST personally retrieve the Prize Vehicle from the specified delivery site within thirty (30) days of written notification of delivery and present adequate personal identification, valid USA driver’s license and evidence of legally required insurance or an alternative winner shall be selected and the original Winner’s rights to the Prize Vehicle shall be automatically forfeited. The Winner shall bear all risk of loss or damage to the Prize Vehicle once he/she takes title of the Prize Vehicle at the specified delivery site. The Winner shall be responsible for all taxes, license, title, tags, emission tests, insurance, registration fees and other costs and expenses, including without limitation any travel or transportation costs associated with winning, obtaining ownership of and/or using the Prize Vehicle. Failure of the Winner to pay such taxes, fees and costs/expenses will result in forfeiture of the Prize Vehicle. In the event the actual value of the Prize Vehicle awarded is less than $39,950, the Winner will not receive the balance in cash, credit or otherwise.
• A VIP racing experience comprised of a four (4) day, three (3) night trip for two (2) persons to Phoenix, AZ scheduled for March 11, 2016 through March 14, 2016 (“Trip”). The approximate retail value (“ARV”) of the Trip is $3,500. Actual Trip dates will be finalized by Sponsor prior to the Winner’s travel. The Trip will include: roundtrip coach air transportation on a carrier of Sponsor’s choice between the Winner’s nearest major airport and Phoenix International Airport; accommodations for two (2) people for three (3) nights (one (1) room (double-occupancy)) at a hotel of Sponsor’s choice; transportation to and from hotel and airport while in Phoenix; STANLEY Racing VIP access on race day to including tour of garage and pit road; meet and greet with a member of the Joe Gibbs Racing team and participate in a ceremonial awarding of key to the Prize Vehicle (the key awarded may not be the actual key to the Prize Vehicle; see above regarding delivery of the Prize Vehicle to the Winner). The Winner and travel companion must travel on the same itinerary. All expenses associated with prize receipt and/or use not expressly described in these Official Rules as included in the Grand Prize are the sole responsibility of the Winner and travel companion. The Trip does NOT include: upgrades in airfare; travel insurance; travel arrangements to and from home airport; additional hotel night stay; additional hotel room(s); meals; additional guest(s); gratuities; baggage fee(s); any other travel-related expense(s) and/or incidental cost(s). Prior to the Trip, travel companion will be required to return to Sponsor or RSM a personally signed liability and publicity release form. The travel companion must be age 21 or older. Sponsor shall not be responsible for any lost, misplaced, stolen, expired, unclaimed or travel vouchers, unused tickets, passes, etc. The Trip may involve strenuous physical activity and there is a risk of personal injury and property damage. Winner and travel companion must assume all of the risk of injury, death or other losses or damages arising out of participation in the Trip. The Trip is subject to all terms and conditions contained on the back of travel vouchers, tickets, passes, etc. In the event the actual value of the Trip awarded is less than $3,500, the Winner will not receive the balance in cash, credit or otherwise. The Winner and travel companion agree to comply with all applicable rules and regulations in connection with the Grand Prize. Sweepstakes Entities reserve the right to remove or deny entry to the Winner and/or travel companion who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person while participating in the Trip. Due to the dates of the Trip, the potential Winner and travel companion must respond promptly to Sponsor, RSM and/or their agents/designees and provide all required documents, items information by stated deadlines; if the Winner and/or travel companion do not timely respond such that Sponsor and/or its agents are unable to make necessary arrangements for the Trip, the Winner will be disqualified and forfeit the Grand Prize in its entirety.
• An assortment of Stanley tools and DEWALT tools and products listed on Exhibit A (“tools prize pack”); the total ARV of the tools prize pack is $2,000. IN ORDER FOR THE WINNER TO RECEIVE THE TOOLS PRIZE PACK, THE WINNER MUST HAVE PARTICIPATED IN THE TRIP AND TAKEN POSSESSION OF THE PRIZE VEHICLE OR THE WINNER WILL FORFEIT SUCH TOOLS PRIZE PACK. The tools prize pack will be mailed to the Winner at his/her street mailing address (cannot ship to a post office box) via regular ground mail 6 to 8 weeks after the Winner has taken possession of the Prize Vehicle. The tools depicted, displayed and/or pictured on the designated landing page or in any advertising, promotional materials or physical display may NOT reflect the actual tools and products awarded.
• A check issued by Sponsor to the Winner in the amount of $7,500 to help offset any tax-related expenses the Winner may incur in connection with the Grand Prize. IN ORDER FOR THE WINNER TO RECEIVE THE CHECK, THE WINNER MUST HAVE PARTICIPATED IN THE TRIP, TAKEN POSSESSION OF THE PRIZE VEHICLE AND RECEIVED THE TOOLS PRIZE PACK OR THE WINNER WILL FORFEIT SUCH CHECK. The check will be mailed to the Winner at his/her street mailing address (cannot ship to a post office box) via regular ground mail approximately 6 weeks after the Winner receives the tools prize pack.
THE WINNER MUST ACCEPT AND CLAIM THE GRAND PRIZE IN ITS ENTIRETY OR NOT AT ALL. The total ARV/MSRP of the Grand Prize in this Sweepstakes is $52,950.
